General Information about Building Regulations

The Department of Fair Trading requires that if work around the home is valued at $2000 or more you should ensure that your contractor (builder or tradesperson) provides you with a contract and if the works are valued at $5000 or more you should be supplied with the appropriate Home Owners Warranty Insurance. This will protect you against faulty workmanship and against any problems that may arise for a period of 7 years. You need to have a signed copy of both the contract and insurance.

Contracts are available from your contractor or from the Department of Fair Trading.

Make sure the contract is a standard, plain English version and that it is appropriate for the value of the works being undertaken. This will be noted on the contact (e.g. minor works, less than $5000, constructions $5000 - $25000, Home Building $25000+). There is a separate contract available for swimming pools. If you have any queries or complaints about a contractor or wish to enquire whether complaints have been previously lodged against the particular contractor, contact the Department of Fair Trading.

While regulations vary from council to council, generally any work which is structural in nature or impacts on the external appearance of the home or the surrounding areas. Special rules apply to Heritage Homes. It is wise to discuss alterations with your local council to determine whether or not they're appoval is required.
